Why are boundary disputes common?
Your property boundary is an invisible line, dividing your property from your neighbouring properties. It should be specified in your conveyance deeds, both in writing and in a plan. Often a physical feature, such as hedging, fencing or a wall is positioned along the boundary. Disputes often occur regarding the positioning of these features, or the boundary itself.
The most common disputes involve
- New fences, hedges or walls
- Extensions
- Ownership of features along the boundary, and the legal right to make changes to those features
The boundary defined in your conveyance deeds may not have been drawn up by a professional RICS Chartered Surveyor and therefore may not contain accurate descriptions that will enable the identification of boundaries.
